The council designated Mirfield Neighbourhood Area on 19 December 2016 in accordance with the Town and Country Planning Act 1990, the Localism Act 2011 and the Neighbourhood Planning (General) Regulations (2012) as amended.

Strategic environmental assessment and habitats regulations assessment
In accordance with the requirements of the Environmental Assessment of Plans and Programmes Regulations 2004 (as amended), which transpose the Strategic Environmental Assessment Directive 2001/42/EC into domestic legislation, the council has determined that the draft Mirfield neighbourhood development plan is not likely to give rise to significant environmental effects and therefore does not require a strategic environmental assessment. Furthermore, in accordance with the Conservation of Habitats and Species Regulations 2017 (as amended), the council has determined that the draft Mirfield neighbourhood development plan is not likely to have significant effects on habitats sites, either alone or in combination with other plans and proposals, and therefore does not require an appropriate assessment.
