We want to consult with residents and businesses to help shape and influence the moving traffic enforcement in Kirklees, currently enforced by West Yorkshire Police.

Kirklees Council plan to submit an application to the Department for Transport (DfT) which will grant the council the powers to enforce moving traffic contraventions under Part 6 of the Traffic Management Act 2004.
We want to use these powers to:
- improve the borough's road network
- and expand the work we already do to improve road safety and tackle congestion
Moving traffic enforcement powers
The purpose of the new powers is so Kirklees can manage specific road locations where there may be issues with persistent moving traffic offences. Currently enforcement of moving traffic offences can only be carried out by the police under criminal law and a penalty notice issued.
These include if you:
- Enter yellow box junctions when the exit is not clear
- Drive through a 'No Entry' sign
- Turn left or right when instructed not to do so
- Drive where, and when, motor vehicles are prohibited
- Drive on routes that are for buses and taxis only
- Go the wrong way in a one-way street
- Ignore a Traffic Regulation Order (TRO)
- Improved road safety including those walking, cycling and wheeling. This can help to encourage more people to take up active travel options
- Reduced traffic congestion
- Improved journey times for public transport services
- Reduction in vehicle emissions which in turn improves air quality and supports our zero-carbon target
- Enabling the Police to focus their policing priorities elsewhere
- Increased safety and cleaner air around schools (Camera enforced school streets schemes are proven to have a positive effect)
We will take a consistent and measured approach to enforcement. Using cameras at sites where it has been identified there is a need.
Each site must help achieve at least one of these:
- Improve road safety
- Encourage active travel choices
- Tackle network congestion
- Increase public transport reliability
- Improve air quality
- Increase lifespan of highway assets
Kirklees has chosen the sites based on a series of technical decisions. We may not continue with this kind of enforcement at these sites, or we may consider different sites later after the trial concludes. This will be subject to being granted DfT approval in November 2025.

A discount will be applied where works are undertaken wholly outside of traffic sensitive times on traffic sensitive streets.
The Government have guidelines that regulate how we must enforce the offences.
All Automatic Number Plate Recognition (ANPR) cameras must be:
- Vehicle Certification Agency (VCA) compliant
- Installed at the sites to be enforced.
Penalty Charge Notices (PCNs) will be issued via post to the 'Registered Keeper' of the vehicle.
For the first six months that we have enforcement powers
- Warning notices will be sent for first time offences and a PCN will not be issued. Any further offence will result in a PCN.

- This must be in writing and within the timescales set out on the PCN
Any income from fines will be used on:
- Recouping the cost of enforcement
- Public transport provision
- Highway improvement projects
- Environmental improvements in Kirklees
