Executive arrangements

Government legislation required all councils to change their executive arrangements in 2010 and choose between:
- a 'new style' Leader and Cabinet of councillors; or
- a directly elected Mayor and Cabinet of councillors.
Kirklees Council formally adopted the new style Leader and cabinet Executive model of governance at its meetings of 9 December 2009 (see Item 9)
and 24 March 2010 (see Item 12). The issue was also discussed at an earlier meeting on 29 July 2009.
The main features of these proposals (which take effect from the meeting of annual council on 26 May 2010) are:
- The Council Executive consists of a Leader and between 2 and 9 other councillors.
- The Leader is elected by Full Council (initially at its annual meeting on 26 May 2010) and holds office until his term as councillor has
expired or the council passes a resolution to remove them.
- Other Executive members are appointed by the Leader who decides their portfolios and also which executive functions are discharged by
the Leader, the full Executive, any of its committees, any individual executive member or officers.
Main changes from previous executive arrangements:
- Under previous executive arrangements, the Leader was elected annually and Full Council appointed the executive members.
- Under the current system the council elects the leader for a term of up to four years, depending on when their term of office as a
councillor expires, and the Leader then appoints the executive members.
The details of how the current executive arrangements are to operate are set out in Article 7 of the council's constitution (the Executive) and
the Executive Procedure Rules. These documents are appended to the report considered by Full Council on 24 March 2010 (see Item 12).
This report also sets out the transitional arrangements (which applied between the dates of the local government elections on 6 May and the annual
council meeting on 26 May 2010).
