Requesting permission for re-use

It is recommended that you have consulted the Guide to re-using council information before applying for the re-use of council information. You may also wish to view the council policy, procedure and standard re-use licence but this is not necessary.
What do I have to do before applying?
In summary before making an application you should have done the following:
  • Obtain the information you wish to re-use
  • Check to make sure that the information is from Kirklees Council and not a separate organisation such as Kirklees Neighbourhood Housing. If Kirklees Council is not the owner of the information then it cannot process a request for re-use. Where the ownership/publisher is unclear we will do our best to advise potential applicants.
  • Decide the way in which you wish to re-use the information.
  • Establish (using the information provided) whether the re-use requires an application to be made.

How do I apply?
For a request to be valid it must:
  • Be in writing (in a legible form).
  • State the name of the applicant and the address for correspondence.
  • Specify the documents that you wish to re-use.
  • State the purpose and way in which the document is to be re-used.
To achieve this you may send a letter or email to the council containing the required information.


What will happen to my request and how long will the process take?
We aim to acknowledge your request within 6 working days (as long as you have provided adequate contact details). If you have not received any contact within 10 days please contact the Corporate Information Management Team.

From receipt of a valid request to sending a decision notification will normally take no longer than 20 working days (from the day after receipt in the council). Complex requests may take longer and you will be notified if this is expected to be the case.

All valid requests are considered by the Corporate Information Management Team, working with the information holders in the relevant parts of the council. You will be informed in writing of the decision. Further information on the internal council procedure can be found in the Licensing the Re-use of Council Information Procedure.

If you have any questions during the process you may contact the Corporate Information Management Team. However, please note that we will not provide any indication of the decision on your re-use request until a final decision has been made.

What could delay the process?
Any requests with incomplete information will not progress in the process until adequate information is provided by the applicant. The council will make reasonable efforts to contact the applicant to obtain this information. If the council is unable to gain contact with the applicant within a reasonable time the process will end. It will then be the responsibility of the applicant to contact the council again with the required information if they wish to the process to start.

If you make the request as part of a request for information then this will also delay the process. The council's procedure for processing requests requires that you have already gained access to the information you require or it is already publicly available. Therefore, if you do not already have access and require the council to provide this then the re-use application process will not start until you have obtained that information. In summary if you make a Freedom of Information request at the same time as requesting permission to re-use the information then your request for re-use will not be considered until the information has been provided to you.

Where you have made a complex request for re-use that involves difficult decisions within the council then the decision will be delayed as long as is reasonable in the circumstances. You will be informed as soon as possible if there is expected to be a delay of this nature.

How much will it cost me?
The charge will depend on a range of factors as detailed in the council policy: Licensing the Re-use of Council Information Policy. Further information on how a decision on fees is made is provided in the Licensing the Re-use of Council Information Procedure. A charge will only be made if in the view of the council this is in the public interest. Therefore some re-use may be allowed for free. Many forms of non-commercial re-use are already allowed for free and without application through the Non-commercial Sharing Licence.

When you make an application you will be informed as early as possible if there is likely to be a charge. By applying for re-use you are not committing yourself to accepting the licence and paying any fee. If you decide that you are not willing to pay the fee requested or cannot accept the terms of the licence then you do not need to continue with the process. Please be aware that the process of evaluating requests for re-use is a time consuming exercise and as such involves a cost to the council. Please take this into account when you formulate your request. The Corporate Information Management Team can provide you with help in formulating your request and where possible giving an indication of possible charges. Any informal information and help provided is not binding and is provided for information only. Decisions on licensing re-use will only be provided through the formal re-use licensing process.

What do I do if I am not happy with the decision?
The Licensing the Re-use of Council Information Policy and Procedure documents set out how requests for review and formal complaints are dealt with.

If you are not happy with the decision please contact the Corporate Information Management Team who will, where possible, provide further explanation of the decision. If you are not happy with this explanation then you are welcome to informally argue your case. Decisions will not normally be reversed through this contact but the process may be reopened if in the view of the council there is a good reason for this.

If we are not able to satisfy you following informal discussions then you may make a formal complaint and this will be handled through the council's Corporate Complaints Procedure.

If after going through this procedure you wish the decision to be reviewed you may make a complaint to the Office of Public Sector Information.
