Housing - March 2011

As a tenant you have the right to:

  • Enjoy your tenancy without any undue interference from anyone.
  • Not be made to leave your home without the landlord following the correct procedures

Harrassment

Harassment is where your landlords or someone who is working for them tries to make you leave the property. This may include:

  • Cutting off your gas, electricity or water supplies.
  • Will not carry out repairs to your home
  • Calls to your house without letting you know, especially if they are late at night.
  • Gaining access to your home when you are not there.
  • Making threats and telling you to leave.

If you feel you are being harassed or threatened with unlawful eviction you need to contact the council's Private Sector Housing Unit

Unlawful eviction

Unlawful eviction is when your landlords or someone working for them forces you to leave you home e.g.

  • Physically thrown out of your home
  • Locks being changed when you are out
  • Not beNot being allowed to enter all or parts of your home

Your landlord cannot force you to leave your home. If they want you to leave they have to follow the correct procedure by serving you with an appropriate notice, and then applying to the County Court for a Possession Order requiring you to leave.

Most, but unfortunately not all landlords will provide a good and secure home for their tenants, and will have no intention of breaking the law and causing distress to tenants.

If you feel you are being harassed or threatened with unlawful eviction you need to contact the council's Private Sector Housing Unit
