Pollution Control - Clean Air Act Approval

Pollution and Noise Control

The Clean Air Act, 1993, consolidated existing legislation which control smoke emissions, the intallation of furnaces and the height of chimneys.
  • Subject to certain conditions, it is an offence to emit dark smoke from industrial chimneys and from the burning of trade or industrial waste in the open.
  • Subject to certain exemptions, it is an offence to emit smoke from any chimney in a smoke control area (The whole of Kirklees is covered by Smoke Control Orders)
  • The Council should be notified of the installation of all non-domestic furnaces (16.12 kW or above) and they should be capable of operating smoklessly
  • Furnaces which (a) burn pulverised fuel, or (b) burn at a rate of 45.4 kg or more an hour any other solid matter, or (c) burn at a rate equivalent to 366.4 kW or more any liquid or gaseous matter require Council approval of chimney height and arrestment plant.
