Consent for Operation of Loudspeakers in Streets

Do I need consent?

Under Section 62 of the Control of Pollution Act 1974 the use of loudspeakers in the street for the purpose of advertising entertainment, trade or business is banned at any time (with the exception of ice-cream vans which are permitted to sound chimes between midday and 7pm). For other uses, the operation of loudspeakers in streets is restricted to the hours between 8am and 9pm.

Between 9pm and 8am it is an offence for a person to operate a loudspeaker in a street, highway, road, footway, square or court which is open to the public.

Exemptions are allowed for the following:

(a) Police, Fire or Ambulance purposes, the Environment Agency, a water or sewerage undertaker in the exercise of its functions, or by a local authority within its area;

(b) For communicating with persons on a vessel for the purpose of directing the movement of that or any other vessel;

(c) Loudspeakers that form part of a public telephone system;

(d) Loudspeakers in or fixed to a vehicle, and operated solely for the entertainment of or for communicating with the driver or a passenger of the vehicle or, where the loudspeaker is or forms part of the horn or similar warning instrument of the vehicle, solely for giving warning to other traffic, and is operated so as not to give reasonable cause for annoyance to persons in the vicinity;

(e) Otherwise than on a highway, by persons employed in connection with a transport undertaking used by the public in a case where the loudspeaker is operated solely for making announcements to passengers or prospective passengers or to other persons so employed;

(f) By a travelling showman on land which is being used for the purposes of a pleasure fair;

(g) In case of emergency;

(h) With written consent from the council.

How do I apply for consent?

Kirklees Council has adopted Schedule 2 of the Noise and Statutory Nuisance Act 1993 and from 1 January 2010 can give consent for the operation of a loudspeaker in a street, highway, road, footway, square or court between the hours of 9:00 pm and 8:00 am.

You should complete an Application for Consent for the Operation of a Loudspeaker in a Street (RTF: 1.86MB) and send it to the Pollution and Noise Team, Environmental Services, Riverbank Court, Wakefield Road, Aspley, Huddersfield HD5 9AA.

The law requires the council to determine the application with 21 days. Please give as much advance notice as possible and note that if an application is made less than 21 days before the event we may not be able to guarantee that the consent will be granted in time.

Please note that consent cannot be granted to use a loudspeaker in any street for the purposes of advertising any entertainment, trade or business or in connection with an election.

How much will it cost?

The application fee will be published in our scheme of fees and charges and will be reviewed annually. The fee may depend on the type of event. Currently, there is no fee.
