What is the council's policy on contaminated land?

Kirklees Council published its Contaminated Land Strategy in April 2001. The document which was reviewed in 2003, and again in 2006, details how Kirklees Council intends to carry out inspections of contaminated land. You can obtain further information and download the Contaminated Land Strategy.

Contaminated land

Contaminated Land is land that contains substances either on the surface or below ground that present a risk to human health or the environment. The contamination is normally caused by past industrial uses; contaminants include (amongst others) oils, tars and chemicals. If not controlled effectively, these substances could harm human health or the environment.

Historically, the Kirklees area has been home to a wide range of industrial activities, many existing for decades. Examples include textiles, dye manufacture, chemical works, engineering works and mining; sites with an industrial past are referred to as Brownfield Sites. Such activities could have impacted the environment and therefore, the potential for contamination needs to be considered during redevelopment.

Re-use of Brownfield Sites

The re-use of Brownfield sites is encouraged in national planning and contaminated land guidance as redevelopment can be used as a tool to secure remediation of a potentially contaminated site as well as ensuring the re-use of a site which may otherwise remain derelict.

What Kirklees Council do about Contaminated Land

We are responsible for enforcing contaminated land legislation. In order to meet legislative requirements, we do the following:
  • We have published a Contaminated Land Strategy which is reviewed regularly and says how we will deal with potentially contaminated sites.
  • We review reports submitted in support of planning applications and comment on their suitability, ensuring compliance with prevailing guidance.
  • We keep a Public Register of sites determined as Contaminated Land. This register can be viewed by contacting the Pollution & Noise Control Team - details are listed below.

Contaminated Land Enquiries

You can ask us what information we may hold about a parcel of land or a particular property. There is a fee of £50/hr + VAT for this service. Time to produce reports varies depending on the nature of questions asked and depth of information requested.

If you wish to make an enquiry, we will need the following information:
  • Your name
  • Your address
  • A contact telephone number
  • The address of the site you wish to enquire about
  • A map of the area with the site of interest clearly marked
  • Questions regarding the site you would like answered - we can only answer specific questions

On reciept of your enquiry an officer will contact you and provide an estimate of costs and turn around time. If you agree to pay the costs, the work will be completed and an invoice sent out after completion.
