REFUSAL OF PERMISSION FOR DEVELOPMENT

In pursuance of its powers under the above-mentioned Act and Order the Kirklees Council (hereinafter called "The Council") as Local Planning Authority hereby refuses to permit:-

 

  OUTLINE APPLICATION FOR RESIDENTIAL DEVELOPMENT (24 DWELLINGS)
 
At: The Piggeries strike Lane, skelmanthorpe, huddersfield

 


In accordance with the plan(s) and applications submitted to the Council on 14 Feb 2007.  The reasons for the Council’s decision to refuse permission for the development are:

 



1. The site lies within an area allocated as Provisional Open Land on the Kirklees Unitary Development Plan; the proposal would prejudice the contribution of the site to the character of its surroundings and the possibility of development in the longer term contrary to Policy D5 of the Unitary Development Plan.

2. The site constitutes Greenfield development where the Authority currently has an adequate supply of brownfield sites and the proposal would be contrary to guidance in PPS3.

3. The proposed development would lead to an intensification of vehicular traffic using the junction of Station Road and Strike Lane which is a currently substandard road junction therefore detrimental to the safety of road users and pedestrians, contrary to Policy T10 from Unitary Development Plan.

4. The proposed development fails to provide adequate provision of public open space at the minimum required rate of 30 square metres per dwelling and is therefore contrary to Unitary Development Plan Policy H18

5. The proposed development fails to provide adequate provision of affordable housing and is therefore contrary to Unitary Development Plan Policies H10 and PPS3.

6. The proposed density is below the national indicative minimum in PPS3 and as such the proposal represents an inefficient use of land prejudicial to the advice in PPS3.
