Building regulations advice notes

In some situations Building Regulations approval may not be required for the work that you may wish to carry
out to your property. Some examples of theses are detailed below. The Regulations generally apply to
the erection of a new building, extension or alterations of an existing one, or to the provision of fittings
such as drains, washing facilities, sanitary conveniences, heat producing appliances, or certain hot water
storage systems. They may also apply if you wish to put an existing building to a different use, for
example where a building is to become a dwelling where previously it was not (e.g. barn conversion).
Where there is doubt whether or not Building Regulation approval is required for any work you are contemplating
carrying out, then the Building Control Section will be pleased to advise. You should also bear in mind
that Building Regulations approval does not imply approval under the Town and Country Planning Act. There
will be instances when a Building Regulation application would be required and a planning application not required
and vice versa. Again the relevant Planning Officer should be contacted.
The following are common examples of where Building Regulations may or may not be required.
Detached Garage (exempt if)
It does not exceed 30m2 floor area and is either: -
a. more than 1m from any point of the boundary of its curtilage or
b. Constructed substantially of non-combustible materials
Internal Structural Alterations (required where)
Any internal structural alterations are carried out e.g. removal of a load-bearing wall.
Porch (exempt if)
At ground level the floor area does not exceed 30m2 providing that any glazing incorporated at low
levels satisfies the requirement of Part N.
Conservatory (exempt if)
At ground level with a glazed or translucent roof where the floor area does not exceed 30m2 again
providing any low level glazing complies with the requirements of Part N.
Recovering of Roof (may be required where)
An existing roof is recovered using materials of a heavier or lighter construction.
Loft Conversion (required)
In all cases regardless of the form of access or use of the floor area. The requirements in respect
of structural and fire precautions can become complicated. It is suggested that professional advice
be sought.
Extension (required)
In all cases e.g. any kitchen, lounge, etc.
Car Port (exempt if)
Single storey less that 30m2 in floor area and open on at least 2 sides.
Greenhouse (exempt)
A greenhouse is normally exempt unless used for retailing, packing or exhibiting.
Small Detached Single Storey Building (exempt)
If not containing sleeping accommodation and: -
- the floor area is less than 30m2 and
- b. built of substantially non-combustible materials, when the building is less than 1m form the boundary.
NB. (b) does not apply if the floor area is less than 15m2
Do I need an Application for building regulations to make changes or additions to my electrical installation?
If you use an electrician who is registered with a competent person's scheme, then you do not need an application.
If you do not use an electrician registered with a competent person's scheme then you may require an application
dependent on the works you are carrying out, please see the table below for common examples.
