Why would I need a licence?
It is a legal requirement under the New Roads and Street Works Act 1991 that all works involving the opening up or breaking open of the public highway are registered in the relevant Highway Authority's Street Works Register. Unless you are a utility company such as British Telecom, Transco, Yorkshire Electricity, Yorkshire Water or Virgin Media you will need to get a licence from the council.
What sort of work does it cover?
Licences are issued for three types of private street works, these are:
  • Works to install or repair a foul or clean water drain or connection.
  • works to install or repair any other type of apparatus, for example, a gas or electricity supply or ducting for computers.
  • breaking or opening the highway for purposes other than installing or repairing apparatus.
Who would normally apply for a licence?
The council would usually expect the owner of the apparatus being installed or repaired to apply, not the appointed contractor. Anyone carrying out street works must have a qualified supervisor and trained operative, who have received training in what is required to excavate, sign and guard the works and reinstate afterwards to the correct standard.
How much does it cost?
The fees at the present time are £380 for works involving installing or repairing apparatus and £220 for opening the highway for any other purpose. These fees are reviewed annually.

How do I apply for a licence ?
You should contact Highways ROSS and ask for an application pack. You can fill out a service request form and an application pack will be sent to you.Alternatively you can ring Highways ROSS on 0800 731 8765 or email highways.ross@kirklees.gov.uk. The pack includes an application form and notes for guidance, which explain all your responsibilities and obligations as a licence holder. You will be issued with an individual reference number when you apply for your application pack.
