How can I find out if land is Council owned ?

The Council's Terrier Section keeps records of all Council owned land and can be contacted on 01484 226190

Where do I go if the land is not Council owned ?

Although the land is not in the Council's ownership, it may still form part of the adopted highway that the Council has responsibility for. If you would like further information please complete the service request form and send details to us. Alternatively, the Land Registry also keep a record of private land ownership. This is not a Council department but can be contacted on 0115 935 1166.

A wall/fence is damaged or in a state of disrepair- how do I find out who's wall it is and who is responsible for repairing it ?
Generally the walls and fences that surround property and fields are erected and maintained by the land owner. These are erected to provide security, privacy and to mark boundaries between different landowners. If you want to report a wall or fence in a state of disrepair please complete the service request form and send the details to us.

Highways and Transportation Service, as a local authority, will maintain and repair:
  • Walls supporting the structure of the highway - these are called Highway Retaining Walls.
  • walls retaining land that has been excavated in cutting to form a highway parapet wall on bridges.
  • walls providing a safety barrier for example a steep drop at the other side of the wall.
Does the Highways and Transportation Authority adopt roads or paths as part of a public highway ?

Who maintains roads ?

How do I find out if a street is a private street ?
Even if a road or path is not maintained by the Authority, the public may still have the right to use it. If you would like to find out if a street is a private street please complete the service request form and send details to us.

What are the limits of the Authority's responsibility?
